1. The POP online auction begins on 3/7/2011 4:00pm PST and runs through 3/16/2011 at which time one category at a time will close every 15 minutes beginning at 6:00pm PDT. 2. All bidders must provide a valid credit card to bid on items. 3. A bid placed on an item constitutes a legal contract to buy by the bidder. 4. For all auction items, default bid increments have been established by the seller. 5. The highest bid submitted for an item at the close of the online auction will be the price the item is sold at. 6. At the close of the auction, the winning bidder will automatically be charged, via the credit card information provided, for the amount equal to the winning bid. 7. The invoiced amount due is expected to be paid in full by Visa or MasterCard using the automated process described above, unless other payment arrangements have been made with the seller in advance. 8. All sales are final; our standard policy is no exchanges or refunds, except under exceptional circumstances. 9. All articles are sold “as is,” and St. Albans Country Day School is not responsible for any errors in the description or authenticity of any item as provided by the donor. 10. It is the buyer's responsibility to pick up purchased goods from the school between the dates of 3/17/11 through 3/23/11. Many of the items have specific conditions such as time limits, availability, etc. Unless otherwise stated or negotiated with the donor, specific items (such as certificates or trips) must be used by March 2012. The buyer is responsible for being aware of exclusions, time limits, requirements, etc., stated on gift certificates or donor forms. Tax, tip, and gratuity are not included unless otherwise stated. Use of vacation homes and private dinners will be scheduled at a mutually agreed upon time unless a specific date is given. Please, no pets and no smoking in vacation homes. 12. Any hotel reservations and air transportation are on a space-available basis and subject to blackout periods. Remember, you are making your reservation based on their generous donation, and your travel arrangements are subject to the donor’s discretion. 13. When using restaurant certificates, please call for reservations if required by the establishment. No cash will be given back by the establishment. Tax and gratuity are not included in the purchase price, and alcoholic beverages may be excluded. 14. It is the Auction Committee’s intent to accurately describe all items within the auction site based on the information provided by the generous donors. St. Albans Country Day School does not appraise or estimate the fair market value (FMV) of auction items and the contributors have furnished all statements of value, Any values quoted are estimates only and not warranted by the St. Albans Parent Association (SAPA) for tax purposes or for general value. 15. In determining the tax deductibility of items purchased at the Auction, Revenue Ruling #67-246 issued August 4, 1988 reminds buyers that no deduction is allowable except to the extent that the taxpayer can show that his or her payment exceeded the FMV of the item or service. a. St. Albans Country Day School provides this information to exercise its responsibility to fully inform its supporters of the applicable tax law but is not responsible for the tax consequences of these transactions. Winning bidders should consult with their own advisors regarding applicable tax laws.
